Welcome to Garm.It. Garm.It is a cultural buy-and-sell marketplace that enables users to list, buy, and sell items rooted in culture, creativity, and community. By accessing or using our website, applications, and services, you agree to be bound by these Terms of Service.

1. Eligibility

You must be at least 18 years old to use Garm.It. By using the Services, you represent and warrant that you are legally able to enter into a binding agreement and that all information you provide is accurate and complete.

By using Garm.It, you also agree to engage respectfully with other users and communities represented on the platform.

2. Accounts

To access certain features of Garm.It, you must create an account. You agree to:

Provide accurate and up-to-date information
Maintain the security of your login credentials
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or our community standards.

3. Marketplace Rules

a. Listings and Sales

Sellers are responsible for:

Accurately describing items listed for sale
Ensuring items are lawful, authentic, and permitted
Fulfilling orders in a timely manner

Buyers are responsible for reviewing listings carefully before purchasing.

b. Prohibited Items and Conduct

You may not list, sell, post, or engage in content or behavior that is:

Illegal, stolen, or counterfeit
Dangerous or prohibited by law
In violation of intellectual property rights
Hateful, discriminatory, harassing, or abusive
Exploitative of cultures, communities, or identities
Misrepresentative or disrespectful of cultural traditions, symbols, or practices

We reserve the right to remove listings, content, or accounts that violate these rules.

4. Payments and Fees

All payments on Garm.It are processed through Stripe, a third-party payment processor. By using the Services, you agree to comply with Stripe’s applicable terms, policies, and privacy practices.

Buyers authorize Stripe to process payments for purchases
Sellers authorize Stripe to process payouts
Garm.It may charge service or transaction fees, which will be disclosed prior to completing a transaction

Payment information is handled in accordance with our Privacy Policy, and Garm.It does not store full payment card details.

5. Shipping, Returns, and Disputes

Sellers are responsible for shipping items as described
Shipping times and costs are determined by sellers unless otherwise stated
Returns and refunds are governed by the seller’s stated return policy, unless required by law

Disputes between buyers and sellers should be resolved directly when possible. garm.it may, but is not obligated to, assist in dispute resolution.

6. User Content

You retain ownership of content you post on Garm.It, including listings, images, descriptions, and messages ("User Content"). By posting User Content, you grant Garm.It a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating, improving, and promoting the Services.

You are solely responsible for your User Content and represent that it:

Is accurate and lawful
Does not infringe on the rights of others
Respects cultures, communities, and individuals
Does not promote hate, discrimination, or cultural harm

We reserve the right to remove User Content that violates these Terms or our community standards.

7. Intellectual Property

All content on Garm.It, excluding User Content, including logos, branding, text, and software, is owned by or licensed to Garm.It and is protected by intellectual property laws. You may not use our intellectual property without prior written permission.

8. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or pose a risk to the platform or community.

You may stop using the Services at any time.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. Garm.It makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Garm.It is a marketplace platform and does not own, create, or verify items listed by users. We do not guarantee the quality, safety, legality, or cultural authenticity of items, though we reserve the right to moderate content to uphold community and cultural respect.

10. Limitation of Liability

To the fullest extent permitted by law, Garm.It shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability for any claim shall not exceed the amount paid by you to Garm.It in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Garm.It and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Garm.It operates, without regard to conflict of law principles.
